Terms of Service

1. About these terms

These terms govern your use of Fineproof (“the Service”), operated by SBIA LIMITED, registered in England & Wales (Company No. 16691652), with its registered office at Unit 82a James Carter Road, Mildenhall, Bury St. Edmunds, England, IP28 7DE.

By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

2. The Service

Fineproof provides landlord compliance software covering Making Tax Digital (MTD) filing, PRS Database registration, AML tenant checks, and EPC tracking. The Service is designed for UK landlords and letting agents.

Important: Fineproof is a software tool, not a tax adviser or legal firm. We do not provide tax, legal, or financial advice. You remain solely responsible for the accuracy of data you submit to HMRC, the PRS Database, or any other authority through our platform.

3. Account registration

  • You must be at least 18 years old to use the Service.
  • You must provide accurate and complete information when registering.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately if you become aware of any unauthorised access.
  • One person or legal entity per account, unless on an Agent plan with team access.

4. Subscriptions and payment

  • Subscriptions are billed monthly in GBP. All prices are exclusive of VAT.
  • Payment is processed securely by Stripe. We do not store your card details.
  • Free trial periods are offered at our discretion and may be withdrawn.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial months, except within the first 14 days (money-back guarantee).

5. Your data

You retain ownership of all data you upload to the Service. We process your data in accordance with our Privacy Policy.

You grant us a limited licence to process your data solely to provide and improve the Service. This includes transmitting data to HMRC, identity verification providers, and other third parties as necessary to fulfil the Service.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false or misleading data to HMRC or any authority via the Service
  • Attempt to access another user's account or data
  • Reverse engineer, decompile, or otherwise attempt to extract the source code
  • Use automated scripts or bots to access the Service
  • Resell or redistribute the Service without written permission

7. Availability and support

We aim to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with prior notice. Emergency maintenance may occur without notice.

Support is available via email. Response times depend on your subscription tier.

8. Intellectual property

All intellectual property rights in the Service (including software, design, trademarks, and content) belong to SBIA LIMITED. These terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.

9. Limitation of liability

To the maximum extent permitted by law:

  • The Service is provided “as is”. We do not warrant that the Service will be error-free or meet your specific requirements.
  • We are not liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunity.
  • Our total liability to you in any 12-month period shall not exceed the amount you paid to us in that period.
  • We are not liable for penalties, fines, or losses arising from incorrect data you submit to HMRC or any authority through the Service.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by English law.

10. Termination

We may suspend or terminate your account if you breach these terms. Upon termination, you may request an export of your data within 30 days. After 30 days, your data will be permanently deleted (subject to legal retention obligations outlined in our Privacy Policy).

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
